NEOTRUCKS places great importance on protecting personal data, ensuring its collection and processing comply with all applicable laws and regulations. This includes, in particular, the amended Data Protection Act of 6 January 1978, and European Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (the “GDPR”) (together the “GDPR Legal Framework”).

This privacy policy (the “Privacy policy”) outlines and summarises NEOTRUCKS’ commitments to the protection of personal data, it being specified that the GDPR legal framework is applicable to any processing of personal data, defined as any operation on one or more items of information (first and last name, telephone number, email, date of birth, etc.) that allows for the direct or indirect identification of a natural person (“personal data”, “data subject”).

1. Data controller

The data controller is NEOTRUCKS SAS, a simplified joint-stock company registered with the BOURG-EN-BRESSE Trade and Companies Register under number B 892 458 308, whose registered office is located at 773, rue de la Plaine, in DAGNEUX (01120) (“NEOTRUCKS”).

2. Processed personal data and means of collection

The personal data processed by NEOTRUCKS, by the “neotrucks.fr” website (the “Website”) and/or by any other means, are as follows:

  • Identification: first & last name, title, gender;
  • University and professional data and/or employment information (appearing in the CVs of potential candidates);
  • Contact details: email address, postal address, telephone number;
  • Any other personal data that may be spontaneously transmitted by the persons concerned, particularly in the body of messages via the Website forms and/or when making contact.

This personal data is collected by the following means:

  • Cookies: when browsing the Site, cookies may be installed on the data subject’s device (see the Cookies Appendix below for more information),
  • Website contact form,
  • When making contact and in the context of our professional relations.

If applicable, the mandatory or optional nature of the provision of data is indicated during collection by an asterisk (*). The obligation to provide data (i) is regulatory or contractual in nature or (ii) determines the processing of the request, including the conclusion and execution of the contract if applicable. Failure to provide this data will result in the inability to process the request and/or conclude/execute the contract. By voluntarily providing data, including optional data, the persons concerned expressly agree that it will be processed in accordance with the purpose indicated at the time of collection and under the conditions of the Privacy Policy.

We may also collect personal data about you indirectly when you share content, comment on or reply to our posts or advertisements on social networks.

3. Purposes of personal data processing

NEOTRUCKS processes personal data for the following purposes:

  • Communication with data subjects to respond to their requests for information and/or quotes,
  • Creation of a customer file and management of the customer relationship,
  • Contract conclusion, execution, processing, management, invoicing and payment,
  • Processing of unsolicited applications, communication with the candidate and, where applicable, the creation of a candidate file,
  • The processing of requests for guarantees/complaints,
  • The provision by third parties for technical, logistical or other functions on its behalf (in particular electronic payment solutions, transportation, accounting, etc.),
  • The improvement of the offer, by inviting customers to participate in surveys, studies, and satisfaction surveys,
  • The development of commercial statistics,
  • Commercial prospecting,
  • Sending newsletters,
  • Handling the enforcement of their rights by the people concerned,
  • Protecting its legitimate interests (in particular debt collection and the enforcement of any legal rights),
  • Fulfilling its legal and regulatory obligations (such as the archiving of documents and accounting and/or tax obligations).

Cookies: the purposes of each cookie used on the Website are available on the consent management platform.

If the personal data of the data subject is to be processed for different purposes, NEOTRUCKS undertakes to inform the data subject and, when required by the GDPR legal framework, to obtain the data subject’s prior consent.

4. Legal basis for personal data processing

Personal data is processed by NEOTRUCKS in accordance with the applicable regulation, and in particular with the GDPR Legal Framework. In this respect, processing is based on one or more of the following legal bases:

  • The free, specific, informed and unambiguous consent of the persons concerned;
  • When required for the fulfilment of NEOTRUCKS’ contractual obligations towards the persons concerned or pre-contractual measures taken at their request;
  • When required for the fulfilment of NEOTRUCKS’ legal and regulatory obligations (such as anti-fraud efforts);
  • When required for the legitimate interests of NEOTRUCKS (such as carrying out satisfaction surveys with a view to improving its offers);
  • When required for pursuing or defending a legal claim by NEOTRUCKS (such as debt recovery, civil or criminal liability proceedings, etc.).

6. Measures applicable to the processing of personal data – Transfers outside the EU

NEOTRUCKS takes all necessary measures to ensure the confidentiality, integrity, and security of personal data, including when working with subcontractors. These measures are designed to mitigate risks and prevent data from being altered, damaged, or accessed by unauthorised third parties.

Personal data is stored within the European Union. However, in certain cases, data may be transferred outside the EU. When this occurs, NEOTRUCKS implements safeguards in line with the GDPR Legal Framework to ensure that recipients maintain a security level equivalent to GDPR standards and provide the necessary guarantees for data protection.

7. Recipients of personal data

Personal data is processed internally.

However, it may be shared with external recipients strictly for the purposes previously outlined and only to the extent required for fulfilling assigned tasks or complying with legal and regulatory requirements.

The main external recipients include:

  • Subcontractors, particularly in the following categories: transport providers, accounting firms, and technical service providers for the Website and information systems;
  • Cookie providers/partners (for more details, see the Cookies Appendix),
  • Social and tax authorities.

Where required, personal data may also be disclosed to authorised third parties in accordance with legal and regulatory provisions, and upon the formal and justified request from judicial authorities.

8. Rights of persons concerned

Pursuant to the GDPR Legal Framework, data subjects have the right to: access, review, rectify, erase, restrict and withdraw consent to the processing of their data. They also have the right to: object to the processing of their data for legitimate reasons and at any time in the context of commercial prospecting, as well as the right to the portability of personal data and to define posthumous directives relating to the handling of personal data.

The request must contain the full name and email or postal address to identify the data subject and send a response. For security reasons and to avoid any fraudulent requests, proof of identity may be requested if these details are deemed insufficient. In accordance with the law, except in specific justified circumstances, this request will be responded to within one month of receipt of the request.

Finally, the persons concerned have the right to lodge a complaint with the CNIL (France’s data protection authority) or any other competent supervisory authority in their country of residence.
