NEOTRUCKS places particular importance on the protection of personal data, which is collected and processed in compliance with applicable laws and regulations. This includes, in particular, the French Data Protection Act of January 6, 1978, as amended, and the European Regulation (EU) 2016/679 of April 27, 2016, concerning the protection of natural persons regarding the processing of personal data and on the free movement of such data (the “GDPR“) (together, the “GDPR Legal Framework“).

This privacy policy (the “Privacy Policy“) sets forth and summarizes NEOTRUCKS’ commitments regarding the protection of personal data. It should be noted that the GDPR Legal Framework applies to all processing of personal data, defined as any operation involving one or more pieces of information (such as name and surname, phone number, email, date of birth, etc.) that directly or indirectly identify an individual (“personal data” “data subject“).

1. Data Controller

The data controller is NEOTRUCKS SAS, a simplified joint-stock company registered with the RCS of BOURG-EN-BRESSE under number B 892 458 308, with its registered office located at 773, rue de la Plaine, DAGNEUX (01120) (“NEOTRUCKS“).

2. Processed Personal Data and Means of Collection

The personal data processed by NEOTRUCKS, through the website “neotrucks.fr” (the “Site“) and/or by any other means, includes the following:

  • Identification: name, surname, title, gender;
  • Academic and professional data and/or employment information (contained in the CVs of potential candidates);
  • Contact details: email address, postal address, phone number;
  • Any other personal data that may be spontaneously transmitted by data subjects, particularly in the body of messages via the Site’s forms and/or during contact.

These personal data are collected by the following means:

  • Cookies: while browsing the Site, cookies may be installed on the data subject’s device (see the Cookies Annex below for more information);
  • Site contact form;
  • • During contact and in the context of our professional relationships.

Where applicable, the mandatory or optional nature of data provision is indicated during collection with an asterisk (*). The mandatory provision of data (i) has a regulatory or contractual character or (ii) is a condition for processing the request, including the conclusion and performance of the contract, if applicable. Failure to provide this data will result in the inability to process the request and/or conclude/perform the contract. By voluntarily providing data, including optional data, data subjects expressly accept that their data will be processed in accordance with the purpose indicated at the time of collection and the conditions of the Privacy Policy.

We may also collect personal data about you indirectly when you share content, comment on, or respond to our posts or announcements on social media.

3. Purposes of Personal Data Processing

The processing of personal data by NEOTRUCKS serves the following purposes:

  • Communication with data subjects to respond to their requests for information and/or quotes;
  • Creation of a customer file and customer relationship management;
  • Contract conclusion, execution, processing, management, billing, and payment;
  • Processing of spontaneously submitted job applications, communication with candidates, and, if necessary, creation of a candidate file;
  • Processing of warranty claims/complaints;
  • Provision of technical, logistical, or other functions by third parties on its behalf (including electronic payment solution, transportation, accounting, etc.);
  • Improvement of the offer by inviting customers to participate in surveys, studies, and satisfaction surveys;
  • Compilation of commercial statistics;
  • Commercial prospecting;
  • Sending newsletters;
  • Management of the exercise of their rights by data subjects;
  • Protection of its legitimate interests (including debt recovery and exercise of any legal rights);
  • Compliance with its legal and regulatory obligations (such as document retention and accounting and/or tax obligations).

If a data subject’s personal data were to be processed for different purposes, NEOTRUCKS commits to informing them and, where required by the GDPR Legal Framework, obtaining their prior consent.

4. Legal Bases for Personal Data Processing

Personal data processing is carried out by NEOTRUCKS in accordance with applicable regulations, particularly the GDPR Legal Framework. As such, they are based on one or more of the following legal bases:

  • The free, specific, informed, and unambiguous consent of data subjects;
  • When necessary for the performance of NEOTRUCKS’ contractual obligations to data subjects or for pre-contractual measures taken at their request;
  • When necessary to comply with NEOTRUCKS’ legal and regulatory obligations (such as fraud prevention);
  • When necessary for the legitimate interests of NEOTRUCKS (such as conducting satisfaction surveys to improve its offerings);
  • When necessary for the exercise or defense of NEOTRUCKS’ legal rights (such as debt recovery, civil or criminal actions for liability, etc.).

5. Data Retention Periods

In accordance with applicable regulations, particularly the GDPR Legal Framework, the retention periods for personal data depend on the purpose of the relevant processing. Accordingly, personal data is retained for a period not exceeding the duration necessary for the purposes for which they are processed, and in any case, for a period not exceeding the maximum legal durations.

Thus:

  • Contact/prospect data: for the time required to process the request, then for a maximum of three years from the date of collection or last contact at the initiative of the person concerned,
  • Customer data: for the duration of the relationship, then until a deletion request is sent or after a certain period of inactivity, set at a maximum of 3 years,
  • Supplier/partner data: for the duration of the business relationship, then for the duration of the applicable statute of limitations.

Lastly, it is specified that certain personal data are kept for longer periods, to ensure (i) compliance with applicable legal and regulatory obligations (such as document retention, invoicing or fraud prevention), and/or (ii) the establishment, exercise or defense of NEOTRUCKS’ legal rights during the applicable statute of limitations.

6. Measures applicable to the processing of personal data – Transfers outside the EU

All necessary measures are put in place to guarantee the confidentiality, integrity and security of personal data, including with regard to subcontractors, in view of the risks involved, in order to prevent personal data from being distorted, damaged or accessed by unauthorized third parties.

Personal data is stored in the European Union. However, when personal data is transferred to certain recipients, it may be transferred outside the European Union. In this case, the appropriate measures resulting from the RGPD Legal Framework are taken to ensure that the recipients concerned provide a level of security comparable to that resulting from compliance with the RGPD Legal Framework and present the guarantees required in this respect.

7. Recipients of personal data

Personal data is processed internally.

However, personal data may be passed on to external recipients, solely for the purposes mentioned above and to the extent strictly necessary to carry out the tasks entrusted to them and/or in accordance with legal and regulatory provisions.

These include the following recipients:

  • Subcontractors, in particular of the following categories: carriers, accounting firms, technical service providers for the Site and information systems;
  • Cookie publishers / partners (on this point, please consult the Cookies Appendix),
  • Social and tax organizations.

Where applicable, personal data may be communicated to third parties authorized by legal and regulatory provisions, in the context of an express, reasoned request from the judicial authorities.

8. Rights of persons concerned

The request must contain the names, first names, email address, or postal address to identify the data subject and send a response. For security reasons and to prevent any fraudulent requests, proof of identity may be requested if these elements are insufficient. In accordance with the law, unless justified special circumstances, this request will receive a response within one month following receipt of the request.

Finally, data subjects have the right to lodge a complaint with the CNIL (French Data Protection Authority) or any other competent supervisory authority in their state of residence.

1. What are “Cookies”?
